# Description
1 You shall ensure that a competent Contractor is employed to carry out the works .
2 The approved Contractor shall acquaint himself/herself with the position of all existing services such as pipelines, water pipes, sewer lines, surface water drains, telephone cables, electricity cables and lighting poles, water mains and the like. The Contractor will consult with the Regional Director, Garissa Region and a right of way necessitated by these works and services shall be addressed in liaison with the relevant parties and service providers
3 You shall provide reflective traffic control road signs displayed on both sides of the works at distances not less than 50m from the works or as directed by the Engineer’s Representative to allow free flow of traffic. Any relocation of other infrastructure services necessitated by these works shall be addressed in liaison with the relevant authorities
4 You shall undertake to make good any damage caused to any other road structures or public utility service(s) as a result of the works. You shall also tidy up the site and remove all surplus materials on completion of the works.
5 You shall comply with clause 27 (2) of The Kenya Roads Act, 2007 which states that ‘where any infrastructure utility is located within a road reserve, the provider or operator of such infrastructure utility shall, upon written request by the responsible Authority relocate such infrastructure utility to a location or alignment approved by the Authority at no cost to the Authority’.
6 During the construction works, you or your representative shall abide by all existing laws and regulations e.g. the Traffic Act, County Government Act, Physical Planning Department’s Requirements, and County By-Laws etc. without prejudice to the Authority’s requirements under any approval.
7 You shall ensure compliance with the Environmental Management and Co-ordination Act (1999) and the Environmental Impact Assessment/ Environmental Audit Regulations, 2003 in liaison with the relevant Authorities.
8 No other new access junction shall be constructed on the said road without prior approval from this office
9 You shall pay per diem for officers supervising the works..
